TERMS AND CONDITIONS
OF BOOKING

THESE TERMS AND CONDITIONS, ORIGINALLY ISSUED ON
01 AUGUST 2000, SET OUT THE DETAILS OF YOUR CONTRACT WITH TRIPOS TRAVEL (CAPE TOWN)
(PTY) LTD OR ANY OF ITS SUBSIDIARIES WITH WHOM YOU DEAL DIRECTLY (HEREINAFTER REFERRED
TO AS “TRIPOS TRAVEL”, “THE COMPANY”, “WE” OR “US”), AND YOU SHOULD READ AND UNDERSTAND
THEM BEFORE MAKING BOOKINGS WITH US. THESE TERMS AND CONDITIONS SUPERSEDE ANY PREVIOUS
TERMS AND CONDITIONS ISSUED BY US

OF, RETAILER OF, OR AGENT FOR, TRAVEL PRODUCTS AND SERVICES AND, IN SO DOING, OUR
LIABILITY WITH REGARD TO THESE ARRANGMENTS IS AS PER THE PARAGRAPHS SET OUT HEREUNDER.
WE PARTICULARLY DRAW YOUR ATTENTION TO THE INDEMNITY CLAUSE AS LAID OUT IN PARAGRAGH
18).
1. MAKING BOOKINGS
By requesting for bookings to be made for yourself and/or the completion of this
form, you are entering into a contract with the Company governed by the terms herein
laid out.
2. PRICING
Prices quoted include ONLY those items specified, and do not cover any
personal expenses such as meals/refreshments, taxes, passport and visa charges.
We reserve the right to alter any prices prior to the final confirmation and documentation
of the booking. We also reserve the right to apply surcharges such as VAT, fees
for chargeable services, landing taxes, embarkation/disembarkation fees at ports
and airports. Such surcharges would be subject to final confirmation at the time
of issue of documents.
3. PAYMENT TERMS
Payment for all transactions must be made by credit card, electronic transfer,
bank guaranteed cheque or bank transfer before travel documents are released, except
from clients with approved credit facilities in which case refer to paragraph 4.
4. CREDIT TERMS
Subject to the full completion of an application, written approval by Tripos
Travel and a strictly enforced credit limit, Corporate Accounts may pay for land
arrangements on a monthly basis not later than the 7th day of the month following
the month of invoice (excluding any pre-paid arrangements such as deposits, package
tours and forex/travelers’ cheques which must be paid for immediately). IATA air
tickets must be paid for with the use of a duly authorised credit card lodged with
the Company. Non-IATA air tickets must be paid for on demand. Passengers traveling
with documents charged to an approved corporate account should be aware that, in
the event of default by or liquidation of such corporate client, they are responsible
for ensuring that the arrangements are paid for in full and thereby stand personal
surety for payment for those specific arrangements.
5. LATE PAYMENT
Tripos Travel reserves the right to charge interest for late payments at
its discretion, and the client hereby acknowledges that it is fair and necessary,
and undertakes to pay such charges.
6. CONFIDENTIALITY
Tripos Travel undertakes at all times to contain the confidentiality of
any client’s travel reservations within the framework of the Law.
7. TRANSACTION FEES
Each transaction will be subject to a fee as per Tripos Travel’s standard
price list, unless a specific customized fee arrangement has been negotiated and
signed by the client.
8. DEPOSITS & CANCELLATIONS
Deposits paid will normally be non-refundable upon cancellation, although
this will depend upon the policy of the specific principal(s) in question. If the
booking is taken, the deposit will be credited against the total cost. Irrespective
of whether a deposit is relevant or not, cancellation fees will be imposed in all
circumstances from both supplier and Tripos Travel (except in exceptional circumstances).
If a deposit was paid, but was refundable, cancellation fees may be deducted from
the refund due. The Company may cancel a booking if a client is deemed to have broken
the terms and conditions herein set out.
9. AMENDMENTS
Any amendments made by the client to a confirmed itinerary after it has
been accepted by the client may attract amendment fees, plus any communication costs
involved in securing further bookings. The Company reserves the right to make minor
changes to travel arrangements if necessary at no cost to the client..
10. REFUNDS
Clients are not permitted to withhold payment where refunds have been applied
for but not yet granted. Tripos Travel acts in good faith for its clients strictly
on an agency basis, and the speed at which it can obtain refunds from principals
is totally out of its control. A simple air ticket refund, at the very quickest,
would be received in the middle of the month following the month in which it was
applied for.
11. GROUP BOOKINGS
A “group booking” is generally defined as any booking involving more than
6 passengers traveling together on one common itinerary. Typically groups will be
corporate delegations, visitors to conferences and conventions, and participants
in a company’s incentive travel scheme. Clients should be aware that groups will
often benefit from superior rates but in so doing will often be asked for substantial
deposits as well as full payment well in advance of traveling.
12. SUNDRY CHARGES (COMMUNICATION COSTS, BANK CHARGES etc)
The Company reserves the right to charge a client any costs above the normal
costs associated with a booking. For example, there may be costs associated with
a booking made late, or outside of normal office hours. Or, wherever a specific
overseas principal is not represented locally, Tripos Travel reserves the right
to charge communication costs. Tripos also reserves the right to charge emergency
fees and after hours fees.
13. TRAVEL INSURANCE & DEFAULT INSURANCE
Tripos Travel can assist with travel insurance according to the terms of section
22 of the Tourism Act 1993. This assistance may involve both advice and the organisation
of documentation, but the onus is on each client to become fully acquainted with
the terms of the insurance offered, and to assess whether the cover taken is sufficient.
Note that credit card reservations automatically provide a limited level of insurance,
but this level is generally not sufficient cover for most travelers’ needs. It is
also possible for clients to insure themselves against default by principals. By
booking with Tripos Travel, clients automatically have the opportunity to request
all forms of travel insurance currently available in the local travel industry.
Indeed, in nay booking where insurance is not taken, the client acknowledges that
such insurance was on offer and available from Tripos Travel and it was declined
by the client. Whilst we may offer advice on the matter of default insurance, clients
must be aware that it acts on behalf of a principal and can in no way be held responsible
for default by a principal. Insurance queries should be addressed directly to the
Principal Insurer and Tripos Travel will in no way be held responsible for any insurance-related
matters.
14. RESERVATION DEPOSIT/ITINERARY PLANNING FEES
Subject to clause 8), all provisional bookings completed with at least
a basic itinerary may attract a non-refundable deposit or itinerary planning fee.
If detailed itineraries are requested in advance of booking, a fee may be requested
up front. These fees will be fully redeemable, in the same way as a deposit, against
the eventual booking.
15. PASSPORTS, VISAS & HEALTH REQUIREMENTS
We can and do provide general information and advice on passport, visa and health
requirements, as well as a service to acquire the relevant documentation. However,
it is your responsibility to ensure that you and everyone in your party have the
appropriate documents to allow entry into the destination country (including vaccination
certificates etc). If any costs arise as a result of your failure to comply with
the necessary requirements, you the client will be liable. You are also advised
to deal with such matters in good time since the Company has no control over consular
delays.
16. FOREIGN EXCHANGE RATE FLUCTUATIONS
Significant fluctuations in exchange rates will often result in short term
price adjustments by Principals and often no guarantees are given by Principals
to protect against this. Accordingly, therefore, the Company reserves the right
to adjust prices at any time to account for these fluctuations if necessary.
17. TRANSPORT TIMES
Your flight numbers and timings of all methods of transport were correct
at the time of booking, but may change. The Company does not take any responsibility
for such changes, but will endeavour to notify clients of any changes which are
brought to its attention. You are advised to check and reconfirm your arrangements
when abroad.
18. INDEMNITY
Tripos Travel hereby indemnifies itself against any claim which a client could have
of whatsoever nature due to a Tour Operator or other Principal not performing according
to the confirmed itinerary, or any claim of whatsoever
nature that is construed by the client to have resulted from Tripos Travel’s negligence.
In the event of such problems, although it is not obliged to do so, at its discretion,
the Company may assist the client in the resolution of such matters, as an act of
goodwill, by receiving details of the problems and passing them on to the Principal.
Even if payment is made directly to the Company, for any arrangements, all coupons,
tickets, receipts and other documents are issued subject to the terms and conditions
specified by the supplier. By accepting such documents and/or by utilising the services,
you are accepting these terms and conditions, and you agree that neither we nor
any of our affiliated companies shall have any obligation to you whatsoever for
the successful delivery of those relevant travel arrangements, or any expectations
not met.
19. COMPLAINTS & DISPUTES
Complaints should be reported immediately to both the supplier of the service
in question, and to the Company. At its discretion, the Company, may, if required,
assist in the resolution of such matters. If the matter is not resolved to the satisfaction
of the client, the matter may be referred to the Association of South African Travel
Agents (“ASATA”) who may arbitrate in the matter.
20. FEES
The Company charges a variety of fees on services provided which are not otherwise
paid for by its suppliers. These fees are listed on an official price list that
each staff member will have a copy of. Tripos Travel staff should, but are not obliged,
to quote such fees at the time of initial booking. Corporate clients booking regularly
may negotiate a tailor-made fee set that is more appropriate to their travel spnding
patterns
21. LAW & JURISDICTION
All legal matters arising out of any booking and concerning the exercising of these
terms and conditions shall be the subject of South African law and the Courts of
the Republic of South Africa.
